Our partner Fernanda Tórtima participated on August 26th in a webinar organized by the Brazilian Institute of Lawyers (IAB) to discuss “The Destruction of Self-Incriminating Evidence by the Investigated Party” alongside Regional Prosecutor Leonardo Cardoso de Freitas. The event was moderated by attorneys Marcio Barandier, president of IAB’s Permanent Criminal Law Commission, and Juliana Sanches.
“It is necessary to establish clearer guidelines to determine when the destruction of evidence should actually be punishable. For instance, the elimination of a document fully within the availability of the investigated party, such as one kept in a drawer at their home, does not seem to me to warrant punishment,” stated Fernanda Tórtima during the discussion.
